(the “Company”) hereby establishes the following privacy policy (this “Privacy Policy”) regarding the protection of personal information of the persons (“Users”) that are using the “Hugmogu” service operated by the Company (the “Services”), and handles the personal information in an appropriate manner in accordance with this Privacy Policy. The meaning of the terms used in this Privacy Policy shall be in accordance with Japan’s Act on the Protection of Personal Information (the “Act”) .
Article 1. Categories of Personal Information to be collected
The Company will collect personal information regarding Users as set forth below. The Services are not applicable to children under the age of 13, thus, the Company does not intentionally collect personal information of children under the age of 13. In the event that the Company collects personal information of children under the age of 13 without obtaining consent from a person with parental authority, the Company shall promptly delete the relevant personal information.

(14) Making contact regarding the services or plans performed by the Company;
(15) Providing the personal information to a third party in the manner stated in this Privacy Policy; and
(16) Other than the foregoing, other purposes incidental to the foregoing Purposes of Use.

1 The Company may collect information regarding Users in order to analyze User access conditions or usage conditions on the website of the Services (the “Website”), distribute advertising to Users, improve the convenience of the Website, and the like, by using files such as cookies, etc., stored on the information communication devices of the Users who access the Website, as well as using technology similar thereto. The Company may link cookies, etc., with the personal information of Users. In this case, taking into consideration the fact that cookies, etc. which are linked with a User’s personal information will be regarded as such User’s personal information, the Company will manage such cookies, etc., in accordance with the provisions set forth in this Privacy Policy.

3 The Company may collect a User’s browsing history on websites, etc. other than the Website collected from a third-party operating data management platform by using technology such as cookies, etc., and the analysis results thereof, and then link such browsing history and analysis results with such User’s personal information retained by the Company, in order to use the same for purposes such as conducting optimized advertising distribution in accordance with the User’s interests or preferences.
4 The Company uses Google Analytics provided by Google, and the Company may receive results from Google’s collection and analysis of the User’s browsing history based on cookies installed by the Company or Google, and use such analyzed results to better understand the User’s usage conditions or for the Company’s services. 5 In order to distribute advertising in line with the interests or concerns of the User, the Company may distribute advertising, by using cookies, through an advertising distribution service provider on its advertising network media. If the User wishes to confirm the details regarding the usage of information in the following company behavior targeted advertising, or if the User wishes to know the procedures when the User wishes to discontinue the acquisition of information by cookies, the User should check the following link. After the opt-out settings for behavior targeting advertising are established, only advertising not in accordance with behavior targeting will be displayed (please note that it may take some time before the opt-out settings are reflected in the system).

Article 4. Measures to Ensure Safety
The Company will take necessary measures to prevent leakage, loss or damage of the personal information collected, and will also appropriately manage the same. (1) Formulating basic policies, and establishing the rules regarding handling of personal information;
(2) Establishing a person responsible for the handling of personal information, as well as a reporting and liaison system;
(3) Clarifying the devices and persons authorized to access and handle personal information, and preventing unnecessary access to personal information;
(4) Keeping the Operating System (OS) included in the devices, etc. that handle personal information up-to-date; and
(5) Introducing security software, etc., to the devices, etc. that handle personal information.
Article 5. Provision of Personal Information to Third Parties
1 Except for the cases set forth below, the Company shall not provide personal information to any third parties without obtaining the User’s prior consent:
(1) Provision in accordance with the laws or regulations;
(2) Provision in cases where it is necessary to protect the life, body or property of a person, and it is difficult to obtain the User’s consent;
(3) Provision in cases where there is a special need to provide the personal information to third parties in order to improve public health or promote the healthy development of children, and it is difficult to obtain the User’s consent;
(4) Provision in cases where it is necessary to cooperate with a national government agency, local government, or person entrusted thereby with performing the functions prescribed by laws or regulations, and obtaining the User’s consent is likely to interfere with the performance of those functions;
(5) Other than the foregoing, if permitted by the laws or regulations.
2 Notwithstanding the preceding paragraph, if any of the following conditions apply, the recipient of the relevant personal information shall not constitute a third party:
(1) If the relevant personal information is provided in connection with all or part of the outsourcing of the handling of personal information within the scope necessary to achieve the Purposes of Use. For example, the Company may provide a delivery company with personal information including the name, address, etc., of the User in order to deliver the products to the User. In addition, the Company may disclose personal information of the User to the outsourcee of the services for operating the Website. In this case, the Company will take measures such as entering into an agreement with the outsourcee to cause the outsourcee to manage the personal information in a strict and appropriate manner; or

(3) Request for correction, addition or deletion of personal information;
(4) Request for suspension of use of personal information; or
(5) Request for suspension of provision of personal information to any third parties;
2 In making the requests or demands set forth in the preceding paragraph, Users are requested to specify any request set forth in the items of the said paragraph and submit documents for identity verification (including a copy of the User’s passport, driver’s license, health insurance card, residence certificate, etc.).
3 With regard to any demand set forth in Item (1) or any request set forth in Item (2) of Paragraph 1, Users are requested to pay commission in the amount of 1,000 yen per demand/request.
